General Terms and Conditions
Article 1: Definitions
In these terms and conditions the following terms shall have the following meanings:
a. Holiday accommodation: tent, folding camper, camper van, (static) caravan, bungalow, summer house, apartment, hiker’s cabin and
such;
b. Castra Holidays GmbH: the company, institution or association that makes the holiday accommodation available to the holidaymaker;
c. Holidaymaker: the person who enters into the agreement with Castra Holidays GmbH regarding the holiday accommodation;
d. Co-recreationalist: the person(s) also indicated on the agreement;
e. Third party: any other person, other than the holidaymaker and/or his fellow holidaymaker(s);
f. Agreed price: the fee paid for the use of the holiday accommodation.
g. Costs: all costs for the entrepreneur related to the operation of the recreational business;
h. Information: written/electronic data about the use of the holiday home, the facilities and the
rules regarding residence;
i. Cancellation: the written termination of the agreement by the holidaymaker, before the effective date of the
stay.
j. A dispute: if a complaint submitted in writing by the holidaymaker to Castra Holidays GmbH has not been resolved to the satisfaction of the parties.

Article 2: Content of the agreement
- Castra Holidays GmbH makes the holidaymaker’s holiday home available for recreational purposes, i.e. not for permanent residence.
a holiday accommodation of the type or kind agreed, for the agreed period and at the agreed price. - Castra Holidays GmbH is obliged to provide the written information on the basis of which this agreement is also concluded to the holidaymaker in advance (digitally). The entrepreneur will always inform the holidaymaker in writing of any changes to this in a timely manner.
- If the amended information deviates significantly from the information provided when entering into the agreement, the holidaymaker has the right to cancel the agreement without charge.
- The holidaymaker is obliged to comply with the agreement and the associated information. He ensures that fellow holidaymaker(s) and/or third party(ies) who visit him and/or stay with him comply with the agreement and the associated information.
- If the provisions of the agreement deviate or are incomplete. This does not affect the fact that the holidaymaker and Castra Holidays GmbH can make individual additional agreements whereby these conditions are deviated from in favor of Castra Holidays GmbH.
Article 3: Duration and termination of the agreement
The agreement ends automatically after the expiry of the agreed period, without any notice of termination being required.
Article 4: Price and price changes - The price is agreed on the basis of the rates applicable at that time, which have been determined by Castra Holidays GmbH.
- If, after the agreed price has been determined, additional costs arise due to an increase in charges on the part of Castra Holidays GmbH as a result of a change in charges and/or levies that directly relate to the holiday accommodation or the holidaymaker, these can be passed on to the holidaymaker, even after the conclusion of the agreement.
Article 5: Payment - The holidaymaker must make payments in euros, unless otherwise agreed, in compliance with the agreed terms.
- When booking, the holidaymaker must pay a deposit of 50% of the agreed price.
- If the holidaymaker, despite prior written notice, fails to meet his payment obligation or fails to meet it properly within a period of two weeks after the written notice, Castra Holidays GmbH has the right to terminate the agreement with immediate effect, without prejudice to the right of Castra Holidays GmbH to full payment of the agreed price.
- If Castra Holidays GmbH is not in possession of the total amount due 8 weeks before arrival, it is entitled to deny the holidaymaker access to the holiday accommodation or to cancel the reservation, without prejudice to the right of Castra Holidays GmbH to full payment of the agreed price.
- The extrajudicial costs reasonably incurred by Castra Holidays GmbH, after a notice of default, shall be borne by the holidaymaker. If the total amount is not paid on time, the statutory interest rate on the outstanding amount will be charged after written notice.
Article 6: Cancellation - In case of cancellation, the holidaymaker pays a fee to Castra Holidays GmbH. This amounts to:
- in case of cancellation more than three months before the commencement date, 20% of the agreed price;
- in case of cancellation within two to three months before the start date, 75% of the agreed price;
- in case of cancellation within one to two months before the start date, 90% of the agreed price;
- in case of cancellation within one week of the start date, 100% of the agreed price.
- The fee will be refunded pro rata, after deduction of administration costs, if the place is reserved by a third party on the recommendation of the holidaymaker and with the written consent of Castra Holidays GmbH, for the same period or part thereof.
Article 7: Use by third parties - Use of the holiday accommodation by third parties is only permitted if Castra Holidays GmbH has given written permission for this.
- Conditions may be attached to the consent given, which must then be recorded in writing in advance.
Article 8: Early departure of the holidaymaker - The holidaymaker owes the full price for the agreed rate period.
Article 9: Interim termination by Castra Holidays GmbH and eviction in the event of an attributable shortcoming and/or unlawful act - Castra Holidays GmbH may terminate the agreement with immediate effect:
a. If the recreational user fails to comply with one of the conditions in this agreement.
b. If the holidaymaker, despite prior warning, causes a nuisance to Castra Holidays GmbH and/or fellow holidaymakers, or spoils the good atmosphere on or in the immediate vicinity of the site;
c. If the holidaymaker, despite prior warning, uses the holiday accommodation in a way that is contrary to the intended use of the site. - If Castra Holidays GmbH wishes interim termination and eviction, it must inform the holidaymaker of this by personally delivered letter. The written warning may be omitted in urgent cases.
- After cancellation, the holidaymaker must ensure that the holiday home is vacated and the grounds are left as soon as possible, but no later than within 4 hours.
- In principle, the holidaymaker remains obliged to pay the agreed rate.
Article 10: Legislation and regulations - Castra Holidays GmbH ensures at all times that the holiday accommodation, both internally and externally, meets all environmental and safety requirements that may be imposed on the holiday accommodation by the government.
- The holidaymaker is obliged to strictly observe all safety regulations applicable on the site. He also ensures that fellow holidaymaker(s) and/or third party(ies) visiting him and/or staying with him strictly observe the safety regulations applicable on the site.
Article 11: Maintenance and construction - Castra Holidays GmbH is obliged to keep the recreation area and the central facilities in a good state of maintenance.
- The holidaymaker is obliged to keep the holiday home and its immediate surroundings in the same condition as when the holidaymaker received it during the term of the agreement.
- The recreational user, fellow recreational user(s) and/or third party(ies) are not permitted to dig, cut down trees, prune shrubs or carry out any other activity of a similar nature on the premises.
Article 12: Liability - Castra Holidays GmbH is in no way liable for any damage suffered. Staying and visiting Castra Holidays GmbH is at your own risk.
- Castra Holidays GmbH is not liable for any accident, theft or damage on its premises.
- Castra Holidays GmbH is not liable for the consequences of extreme weather conditions or other forms of force majeure.
- Castra Holidays GmbH is not liable for any disruptions to utility services.
- The holidaymaker is liable to Castra Holidays GmbH for damage caused by the actions or omissions of himself, the fellow holidaymaker(s) and/or third party(ies), insofar as the damage can be attributed to the holidaymaker, the fellow holidaymaker(s) and/or third party(ies).
- Castra Holidays GmbH undertakes to take appropriate measures after a holidaymaker has reported nuisance caused by other holidaymakers.
- It is strictly forbidden to perform illegal activities (downloading/uploading protected media) on the internet network of Castra Holidays GmbH, the network is made available to all holidaymakers under a fair use policy. Should one holidaymaker use too much data, his connection may be temporarily disabled to give other holidaymakers space on the network.
Article 13: Dispute resolution - All disputes relating to the agreement are subject to German law.
- In the event of a dispute regarding the conclusion or execution of this agreement, the dispute must be submitted in writing no later than 2 months after the date on which the holidaymaker submitted the complaint to Castra Holidays GmbH.
Article 14: Deposit - Upon arrival, the holidaymaker must pay a deposit of €150.
- The deposit relates to, among other things, leaving the accommodation without damage, defects and/or missing inventory.
- If the accommodation is not left clean, cleaning costs will be charged, depending on the level of pollution (cleaning rate: €35 per hour).
- When leaving the accommodation clean and free of damage, defects or missing inventory, Castra Holidays GmbH will refund the deposit to the holidaymaker within 2 working days on the account number known to us.
- In the event of a (possible) claim on the deposit, Castra Holidays GmbH will inform the holidaymaker in a timely manner of the facts observed.
Article 15: Pets - The accommodations at Castra Holidays GmbH are pet-friendly, 3 pets are allowed per apartment. For more pets, a request must be submitted to Castra Holidays GmbH.
- The holidaymaker will ensure that his pets do not cause any nuisance to (fellow) holidaymakers and/or third parties; in the event of (excessive) noise (barking, yelling, etc.), the holidaymaker must ensure that this stops as soon as possible.
- Dogs must always be kept on a leash, with the only 2 exceptions; the designated off-leash area and the rented apartment with private garden.
- Castra Holidays GmbH is in no way liable for damage (claims) between (fellow) holidaymakers and/or third parties for damage caused to or by their pets to (fellow) holidaymakers and/or third parties.
- All dogs must be vaccinated against rabies.
Article 16: Amendments - Changes can only be made in writing.
